Terms of Service

Welcome to SCOOTSCOOT. These Terms of Service ("Terms") govern your access to and use of our platform, website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using SCOOTSCOOT's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our platform. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Possess a valid driver's license or permit as required by local law
  • Not be prohibited from using the Services under applicable laws
  • Provide accurate and complete registration information

By using our Services, you represent and warrant that you meet all eligibility requirements.

3. Platform Role and Limitations

Marketplace Platform Only

SCOOTSCOOT IS A TECHNOLOGY PLATFORM THAT CONNECTS RIDERS WITH INDEPENDENT THIRD-PARTY SCOOTER RENTAL SHOPS. WE ARE NOT A SCOOTER RENTAL COMPANY, TRANSPORTATION PROVIDER, OR TOUR OPERATOR.

SCOOTSCOOT does not own, operate, manage, control, or provide scooters, motorcycles, or any vehicles. We do not employ or control rental shop owners, operators, or staff. All scooters listed on our platform are owned and operated by independent third-party rental businesses.

No Control Over Third Parties

SCOOTSCOOT has no control over and does not guarantee:

  • The condition, safety, quality, or legality of scooters listed on the platform
  • The accuracy of rental shop listings, descriptions, or pricing
  • The ability or willingness of rental shops to complete transactions
  • The conduct, identity, or background of rental shop operators or staff
  • The maintenance, inspection, or repair practices of rental shops
  • Compliance with local laws, regulations, or safety standards by rental shops
  • The availability of insurance coverage or adequacy of such coverage

Independent Contractor Relationship

Rental shops are independent contractors and not employees, agents, or partners of SCOOTSCOOT. The rental agreement is directly between you and the rental shop. SCOOTSCOOT is not a party to that agreement and has no obligations or liability under it.

Limited Role

Our role is limited to: (1) providing the technology platform to facilitate connections between riders and rental shops; (2) processing payments on behalf of rental shops; and (3) providing customer support related to the use of our platform. We do not provide, supervise, or control the actual rental services.

4. User Accounts

Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion.

5. Use of Services

For Riders

When renting a scooter through our platform, you agree to:

  • Complete identity verification (passport and selfie) before booking
  • Provide valid identification and driver's license to the rental shop at pickup
  • Pay the service fee online at the time of booking
  • Pay the rental price and any deposit directly to the rental shop at pickup
  • Inspect the scooter before use and report any damage
  • Operate the scooter safely and in compliance with local traffic laws
  • Return the scooter in the same condition as received
  • Not sublease or transfer the rental to another person

For Rental Shops

When listing scooters on our platform, you agree to:

  • Provide accurate information about your scooters, pricing, and services
  • Maintain scooters in safe, working condition
  • Comply with all local business and safety regulations
  • Honor confirmed bookings and provide agreed-upon services
  • Verify rider identity (passport check) at pickup
  • Collect rental fees and deposits directly from riders at your shop
  • Respond promptly to customer inquiries and issues
  • Use the blacklist feature responsibly and in good faith

6. Prohibited Activities

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit viruses, malware, or other harmful code
  • Engage in fraudulent, deceptive, or misleading practices
  • Harass, abuse, or harm other users or rental shops
  • Attempt to gain unauthorized access to our systems
  • Use automated systems to access the Services without permission
  • Interfere with or disrupt the Services or servers
  • Create multiple accounts to circumvent restrictions
  • Use the Services for any illegal or unauthorized purpose

7. Blacklist and Community Safety

Shared Blacklist

SCOOTSCOOT maintains a shared blacklist system that allows rental shops to flag riders who have caused damage, theft, or other issues. Blacklist entries are visible to all rental shops on the platform. If you are added to the blacklist, your ability to book scooters may be restricted or suspended.

Blacklist Disputes

If you believe you have been unfairly blacklisted, you may contact us to request a review. We will investigate in good faith but are not obligated to remove blacklist entries made by rental shops.

Identity Verification

Riders are required to verify their identity through passport scanning and selfie upload before they can book. This information is used to confirm your identity with rental shops and maintain trust across the platform. Rental shops verify your passport in person at pickup.

8. Scootie Gang and Social Features

Scootie Gang

The Scootie Gang is an activity-based social feature that automatically connects riders who participate in shared activities or book at the same locations. Connections are formed based on your activity on the platform, not manual friend requests.

Social Map and Location Sharing

Our social map feature allows riders to see other active riders in their area. By using the app, you consent to sharing your approximate location with other riders on the platform. You can manage your location visibility in your account settings.

In-App Messaging

SCOOTSCOOT provides messaging between riders and rental shops. You agree to use messaging respectfully and not to send spam, harassment, or inappropriate content. We reserve the right to monitor messages for safety purposes.

9. International Driver's License

What It Is

SCOOTSCOOT offers an International Driver's License as a supplementary verification document. This document confirms your identity has been verified through our platform and includes a QR code for instant verification by rental shops and local authorities.

THIS IS NOT A GOVERNMENT-ISSUED DRIVER'S LICENSE. It does not replace your domestic driving license or any government-issued permit. You must carry valid government-issued identification alongside this document at all times.

Rider Obligations

By purchasing an International Driver's License, you agree to:

  • Follow all local traffic laws, road rules, and customs in the country where you ride
  • Accept sole responsibility for your safety and actions while riding
  • Present the license alongside valid government-issued identification when requested
  • Not use the license as a substitute for a domestic driving license
  • Not transfer, share, or misrepresent the license to others

Validity and Expiration

Licenses are issued for a fixed duration (3, 6, or 12 months) selected at purchase. The license expires automatically at the end of the selected period. Expired licenses cannot be used and must be renewed by purchasing a new one.

Refund Policy

International Driver's License purchases are non-refundable once the license has been issued and activated. If there is a technical issue preventing activation, contact us for assistance.

Revocation

SCOOTSCOOT reserves the right to revoke your International Driver's License at any time if you violate these Terms, are added to the shared blacklist, or engage in conduct that endangers yourself or others. No refund will be issued for revoked licenses.

Liability

SCOOTSCOOT is not liable for any accidents, injuries, fines, legal issues, or other consequences arising from your use of the International Driver's License. The license does not provide insurance, legal representation, or protection from local law enforcement. You are solely responsible for ensuring you are legally permitted to operate a motor vehicle in the jurisdiction where you ride.

10. Payments and Fees

How Payments Work

Daily rental prices are set by individual rental shops and displayed on our platform. When a rider books a scooter, there are two separate payments:

  • Service fee (paid online): A small fee paid by the rider at the time of booking through our platform. This confirms the reservation and covers platform costs.
  • Rental price + deposit (paid at the shop): The full daily rental rate and any security deposit are collected directly by the rental shop when the rider picks up the scooter.

Rental shops keep 100% of their rental price and deposit. SCOOTSCOOT does not hold, manage, or process rental payments on behalf of shops.

Service Fee

The service fee is processed through third-party payment processors at the time of booking. You agree to provide valid payment information and authorize us to charge your payment method for the service fee. Service fees are generally non-refundable unless otherwise stated.

Cancellations

Cancellation policies are determined by individual rental shops and displayed at the time of booking. If a booking is cancelled, the service fee may or may not be refunded depending on the circumstances and timing.

Deposits and Damages

Rental shops may require security deposits, collected directly at pickup. Deposit amounts are set by the shop and displayed on the listing. You are responsible for any damage to the scooter beyond normal wear and tear. Damage charges will be assessed by the rental shop based on repair costs.

11. Ride Protection, Liability, and Assumption of Risk

Assumption of Risk

YOU ACKNOWLEDGE AND AGREE THAT OPERATING A SCOOTER, MOTORCYCLE, OR ANY MOTOR VEHICLE INVOLVES INHERENT AND SIGNIFICANT RISKS, INCLUDING BUT NOT LIMITED TO RISK OF SERIOUS INJURY, PERMANENT DISABILITY, DEATH, AND PROPERTY DAMAGE.

By using our Services to rent a scooter, you voluntarily assume all risks associated with:

  • Operating the scooter, including accidents, collisions, and loss of control
  • Road conditions, weather conditions, and traffic
  • Mechanical failures, defects, or malfunctions of the scooter
  • Actions or negligence of other drivers, pedestrians, or third parties
  • Your own lack of experience, skill, or judgment in operating a scooter
  • Inadequate safety equipment or protective gear
  • Unfamiliarity with local roads, traffic laws, or driving customs
  • Theft, vandalism, or damage to the scooter while in your possession

No Liability for Accidents or Injuries

SCOOTSCOOT IS NOT LIABLE FOR ANY ACCIDENTS, INJURIES, DEATH, PROPERTY DAMAGE, OR ANY OTHER HARM ARISING FROM OR RELATED TO YOUR RENTAL OR OPERATION OF A SCOOTER.

You acknowledge that SCOOTSCOOT is not responsible for and has no liability for any personal injury, bodily injury, emotional distress, death, property damage, or any other damages or losses you may suffer as a result of renting or operating a scooter obtained through our platform, regardless of whether such damages result from:

  • Defects in the scooter or failure of the rental shop to properly maintain the scooter
  • Negligence of the rental shop, its employees, or agents
  • Your own negligence or that of other riders
  • Road conditions, weather, or other environmental factors
  • Actions of third parties, including other drivers or pedestrians
  • Theft of or damage to the scooter
  • Any other cause whatsoever

Ride Protection

SCOOTSCOOT offers ride protection as part of the booking process. Ride protection is not insurance. It is a limited coverage plan provided by SCOOTSCOOT to help cover certain costs in specific situations. The terms and limitations of ride protection are displayed at the time of booking.

Ride protection does not replace insurance. You are solely responsible for:

  • Understanding the scope and limitations of ride protection
  • Determining whether additional insurance coverage is necessary
  • Obtaining your own travel, health, or liability insurance as appropriate
  • Understanding what coverage, if any, is separately provided by the rental shop

SCOOTSCOOT makes no representations or warranties regarding the adequacy of ride protection for your specific situation. We strongly recommend obtaining your own travel and health insurance.

Rider Responsibility and Safety

You are solely responsible for:

  • Your own safety and the safety of others while operating a scooter
  • Inspecting the scooter before use and refusing to operate any unsafe vehicle
  • Wearing appropriate safety equipment, including helmets and protective gear
  • Operating the scooter in a safe and lawful manner
  • Complying with all traffic laws, regulations, and local ordinances
  • Not operating the scooter while impaired by alcohol, drugs, or fatigue
  • Assessing your own skill level and experience before renting
  • Understanding the controls and operation of the specific scooter model

Accidents and Incidents

In the event of an accident, collision, injury, theft, or any incident involving the scooter, you must:

  • Immediately stop and remain at the scene as required by law
  • Contact local police and emergency services as necessary
  • Notify the rental shop as soon as reasonably possible
  • Cooperate fully with any investigation by authorities or the rental shop
  • Provide accurate and truthful information about the incident
  • Not admit fault or liability without consulting the rental shop
  • Document the incident with photos and witness information if possible

You acknowledge that SCOOTSCOOT has no obligation to provide assistance, support, or compensation in the event of an accident or incident. Any claims must be directed to the rental shop or applicable insurance provider.

Medical and Emergency Expenses

You are solely responsible for all medical expenses, emergency services, hospital bills, and any other costs arising from injuries sustained while renting or operating a scooter. SCOOTSCOOT has no obligation to pay for or reimburse any such expenses.

Property Damage

You are liable for all damage to the scooter beyond normal wear and tear, as well as any damage to third-party property caused by your operation of the scooter. This includes but is not limited to:

  • Collision damage, scratches, dents, and broken parts
  • Mechanical damage from improper operation or neglect
  • Theft or vandalism while the scooter is in your possession
  • Damage to other vehicles, property, or infrastructure
  • Loss of use or diminished value of the scooter

12. Third-Party Services and Rental Shops

Independent Third Parties

All rental shops listed on our platform are independent third-party businesses. SCOOTSCOOT does not employ, supervise, direct, or control rental shops or their employees. We do not screen, vet, or verify the qualifications, licenses, or backgrounds of rental shop operators.

No Endorsement or Guarantee

Listing a rental shop on our platform does not constitute an endorsement, recommendation, or guarantee of quality, safety, or reliability. We make no representations about the trustworthiness, competence, or legitimacy of any rental shop.

Direct Relationship

Your rental agreement is directly with the rental shop, not with SCOOTSCOOT. Any disputes, claims, or issues arising from the rental must be resolved directly with the rental shop. SCOOTSCOOT is not a party to the rental agreement and has no obligations under it.

Third-Party Content

Rental shop listings, descriptions, photos, prices, and other content are provided by the rental shops themselves. SCOOTSCOOT does not verify the accuracy or completeness of such content and is not responsible for any errors, omissions, or misrepresentations.

No Liability for Third-Party Actions

SCOOTSCOOT is not liable for any acts, errors, omissions, representations, warranties, breaches, or negligence of any rental shop, or for any personal injuries, death, property damage, or other damages or expenses resulting from rental shop actions or failures to act.

13. Intellectual Property

Our Content

All content on our platform, including text, graphics, logos, images, software, and design, is owned by SCOOTSCOOT or our licensors and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.

User Content

You retain ownership of content you submit to our platform (reviews, photos, etc.). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with our Services.

Trademarks

SCOOTSCOOT and our logos are trademarks of SCOOTSCOOT. You may not use our trademarks without our prior written consent.

14. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Platform Disclaimer:

SCOOTSCOOT IS A TECHNOLOGY PLATFORM ONLY. WE DO NOT PROVIDE TRANSPORTATION SERVICES OR FUNCTION AS A TRANSPORTATION CARRIER. WE DO NOT OWN, OPERATE, MANAGE, OR CONTROL ANY SCOOTERS, VEHICLES, OR RENTAL BUSINESSES. ALL SCOOTERS ARE OWNED AND OPERATED BY INDEPENDENT THIRD-PARTY RENTAL SHOPS.

No Warranties Regarding:

  • The safety, quality, condition, or legality of scooters listed on the platform
  • The accuracy, reliability, or completeness of rental shop listings or information
  • The ability of rental shops to provide services or honor bookings
  • The conduct, qualifications, or background of rental shop operators
  • The availability or adequacy of insurance coverage
  • Compliance with local laws, regulations, or safety standards
  • That the Services will be uninterrupted, secure, or error-free
  • That defects will be corrected or that our servers are virus-free
  • The results that may be obtained from use of the Services

No Responsibility For:

  • Accidents, injuries, death, or property damage related to scooter rentals
  • Mechanical failures, defects, or malfunctions of scooters
  • Actions or omissions of rental shops or their employees
  • Disputes between riders and rental shops
  • Theft, vandalism, or damage to scooters
  • Road conditions, weather, or other environmental factors
  • Your ability to legally operate a scooter in any jurisdiction

You acknowledge that you use the Services and rent scooters at your own risk. SCOOTSCOOT makes no representations or warranties that the Services or any scooters will meet your requirements or be suitable for your intended use.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SCOOTSCOOT, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

This limitation applies to damages arising from:

  • Personal injury, bodily injury, emotional distress, pain and suffering, or death resulting from scooter rental or operation
  • Accidents, collisions, crashes, or any incidents involving scooters obtained through our platform
  • Property damage to the scooter, your property, or third-party property
  • Medical expenses, hospital bills, rehabilitation costs, or lost wages
  • Mechanical failures, defects, or malfunctions of scooters
  • Acts or omissions of rental shops, their employees, or other third parties
  • Theft, vandalism, or damage to scooters while in your possession
  • Inadequate or invalid insurance coverage
  • Use or inability to use the Services
  • Unauthorized access to or alteration of your data or communications
  • Statements or conduct of any third party on the Services
  • Any other matter relating to the Services or scooter rentals

Maximum Liability:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCOOTSCOOT'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES OR ANY SCOOTER RENTAL SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO SCOOTSCOOT IN SERVICE FEES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100 USD).

Essential Purpose:

You acknowledge that these limitations of liability are an essential element of the agreement between you and SCOOTSCOOT, and that SCOOTSCOOT would not provide the Services without these limitations.

Jurisdictional Limitations:

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless SCOOTSCOOT, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, partners, suppliers, and licensors (collectively, the "SCOOTSCOOT Parties") from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees and court costs), arising out of or relating to:

  • Your access to or use of the Services
  • Your rental, possession, or operation of any scooter obtained through our platform
  • Any accidents, collisions, crashes, or incidents involving you or a scooter while in your possession
  • Any personal injury, bodily injury, death, or property damage caused by or arising from your operation of a scooter
  • Your violation of these Terms or any applicable laws or regulations
  • Your violation of any rights of another person or entity, including rental shops
  • Any damage to or theft of a scooter while in your possession or control
  • Your failure to comply with traffic laws or operate a scooter safely
  • Your failure to have proper licenses, permits, or insurance
  • Any content or information you submit to the platform
  • Your breach of any rental agreement with a rental shop
  • Any disputes between you and a rental shop or other users
  • Any claims by third parties arising from your use of the Services

Defense and Settlement:

SCOOTSCOOT reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate fully with SCOOTSCOOT in the defense of any such claims. You may not settle any claim without SCOOTSCOOT's prior written consent.

Survival:

This indemnification obligation shall survive the termination of these Terms and your use of the Services.

17. Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us at legal@scootscoot.app to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

Arbitration

Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Delaware, United States, and judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and SCOOTSCOOT individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in the State of Delaware, United States for any actions not subject to arbitration.

19. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease.

You may terminate your account at any time by contacting us. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

20. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SCOOTSCOOT regarding the Services.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Force Majeure

SCOOTSCOOT shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, or government actions.

Acknowledgment
